Welcome to UMSZ BIKEZ! The terms "we", "us" and "our" refer to UMSZ BIKEZ. UMSZ BIKEZ operates this store and website, including all related information, content, features, tools, products and services to provide you, the customer, with a customized shopping experience (the "Services"). UMSZ BIKEZ is powered by Shopify, which enables us to deliver the Services to you.

The general terms and conditions below, together with any policies referred to therein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with these Terms of Service or the Privacy Policy, you should not use or access our Services.

SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you declare that you are at least 18 years old, and you have given us permission to allow minors dependent on you to use the Services on devices that you own, purchase or manage.

To use the Services, including opening or browsing our webshops or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, delivery address and payment details. You declare and guarantee that all information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.

You are solely responsible for the security of your account login credentials and for all your account activities. You may not transfer, sell, assign or license your account to another person.

SECTION 2 - OUR PRODUCTS
We have done our utmost to provide an accurate representation of our products and services in our webshops. However, please note that colors or the appearance of products may differ from how they appear on your screen, due to the type of device you use to access the store and the settings and configuration of your device.

We do not guarantee that the appearance or quality of products or services purchased by you will meet your expectations or be the same as depicted or delivered in our webshops.

All product descriptions may be changed at any time without prior notice at our sole discretion. We reserve the right to discontinue a product at any time and may limit the quantities of products we offer to a person, geographic region or jurisdiction on a case-by-case basis.

Our electric bicycles are delivered in accordance with the European regulations for electrically assisted bicycles applicable at the time of purchase (motor power maximum 250W, pedal assistance up to 25 km/h, no throttle unless expressly stated otherwise). It is not permitted to modify or have modified the motor, power or speed limiter of the vehicle ("tuning"). Such modification may bring the vehicle under moped legislation (with requirements such as registration, insurance, helmet obligation and driving license) and voids both the factory warranty and any liability of UMSZ BIKEZ for consequences thereof. The consumer is and remains personally responsible for lawful use of the vehicle on public roads.

SECTION 3 - ORDERS
When you place an order, you make an offer to purchase. UMSZ BIKEZ reserves the right to accept or refuse your order for any reason at its sole discretion. Your order is only accepted after UMSZ BIKEZ has confirmed acceptance. We must receive and process your payment before your order is accepted. Check your order carefully before submitting it, as UMSZ BIKEZ may not be able to process cancellation requests after an order has been accepted. In the event that we do not accept, modify or cancel an order, we will attempt to notify you by contacting the email address, billing address and/or phone number provided when you placed the order.

Your purchases may only be returned or exchanged in accordance with our Refund Policy.

You declare and guarantee that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 4 - PRICING AND BILLING
Prices, discounts and promotions may be changed without prior notice. The price charged for a product or service is the price applicable at the time the order is placed and is stated in the email confirming your order. Unless expressly stated otherwise, stated prices are inclusive of VAT; shipping and handling costs and customs or import duties are stated separately.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases you make in our stores.

You declare and guarantee that (i) the payment information you provide is truthful, correct and complete, (ii) you are duly authorized to use the payment method used for the purchase, (iii) charges incurred by you will be honored by your payment provider, and (iv) you will pay charges incurred by you at the stated prices, including shipping and administrative costs and all applicable taxes.

SECTION 5 - SHIPPING AND DELIVERY
We are not liable for delays in shipping and delivery. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers or events beyond our control. Once we transfer the products to the carrier, title and risk of loss pass to you.

SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, the design, selection and arrangement thereof, are owned by UMSZ BIKEZ, its affiliates or licensors and are protected by applicable patent, copyright and other intellectual property laws.

These Terms allow you to use the Services solely for personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit the material on the Services without our prior written consent.

The names, logos, product and service names, designs and slogans of UMSZ BIKEZ are trademarks of UMSZ BIKEZ or its subsidiaries or licensors. You may not use such trademarks without prior written permission from UMSZ BIKEZ.

SECTION 7 - OPTIONAL TOOLS
You may have access to customer tools offered by third parties as part of the Services, over which we have no control. Any use by you of such tools is entirely at your own risk.

SECTION 8 - THIRD-PARTY LINKS
The Services may contain materials and hyperlinks to third-party websites. We are not responsible for their content or accuracy. If you decide to leave the Services to access these materials or sites, you do so at your own risk.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
UMSZ BIKEZ is powered by Shopify, which enables us to deliver the Services to you. However, all sales and purchases you make in our Store are conducted directly with UMSZ BIKEZ. Shopify is not responsible for any aspect of a sale between you and UMSZ BIKEZ.

SECTION 10 - PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy. By using the Services, you acknowledge that you have read this privacy policy.

SECTION 11 - FEEDBACK
If you submit ideas, suggestions, feedback, reviews or other content, you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display such Feedback, including for commercial use. We are not obliged to treat Feedback as confidential or to compensate you.

We reserve the right to correct any errors, inaccuracies or omissions, and to change information or cancel orders if the information is incorrect, at any time without prior notice.

You may only visit and use the Services for lawful purposes, and not to defraud, infringe on the rights of others, spread harmful code, or otherwise cause damage to UMSZ BIKEZ or users of the Services.

We may terminate this agreement or your access to the Services at any time at our sole discretion, and you remain liable for all amounts due up to the date of termination.

UNLESS EXPRESSLY STATED BY UMSZ BIKEZ, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, TO THE EXTENT PERMITTED BY LAW.

SECTION 17 - LIMITATION OF LIABILITY
TO THE EXTENT PERMITTED BY LAW, UMSZ BIKEZ, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES OR AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS.

SECTION 18 - INDEMNIFICATION
You agree to indemnify UMSZ BIKEZ, Shopify and our affiliates from all losses, damages or claims arising from your violation of these Terms of Service or the law.

SECTION 19 - SEVERABILITY
If any provision of these Terms of Service is found to be unlawful or unenforceable, the remaining provisions shall remain in full force and effect.

SECTION 20 - WAIVER; ENTIRE AGREEMENT
Our failure to exercise a right does not constitute a waiver. These Terms of Service constitute the entire agreement between you and us.

SECTION 21 - ASSIGNMENT
You may not assign this Agreement without our prior written consent. We may do so, without notice to you.

SECTION 22 - APPLICABLE LAW
These Terms of Service are governed by Dutch law. Disputes shall be submitted to the competent court in the Netherlands.

SECTION 23 - HEADINGS
The headings used in this agreement are for convenience only and do not limit these Terms.

SECTION 24 - CHANGES TO THE TERMS OF SERVICE
We reserve the right to update these Terms of Service. Your continued use of the Services after publication of changes constitutes your acceptance thereof.
